Chapter I. General Provisions


1. Legislation on the service in the internal affairs bodies shall be based on the Constitution of the Republic of Azerbaijan, and comprise Police ACT of the Republic of Azerbaijan, this Regulation and other legislation instruments of the Republic of Azerbaijan.
2. Provisions of the Public Service ACT of the Republic of Azerbaijan related to the rights of citizens to be admitted to public service, recruitment to service on the basis of competition and by means of transparent procedures, shall be applied to persons recruited to service in the internal affairs bodies.
3. In order to regulate the relations between the persons, employed by the internal affairs bodies, as well as, to determine the term of their office and the quality of their qualification, the classification of posts in terms of private and low-, small-, middle-, high- and supreme superior level posts; and special ranks shall be introduced.
4. Citizens of the Republic of Azerbaijan who exercise authorities provided by the legislation of the Republic of Azerbaijan, have special ranks conferred on them, occupy private and low-, middle-, high- and supreme superior level posts or are in the personnel reserve of the internal affairs bodies, as well as, students of the educational facilities of the respective executive body of the Republic of Azerbaijan, shall be considered employees of the internal affairs bodies.
5. Employees of the Internal Affairs Bodies shall be provided, at the expense of the state, with the uniform and discerning signs. The respective executive body of the Republic of Azerbaijan shall approve the design of the uniform and the lay-out of the discerning sign.
6. Employees of the internal affairs bodies shall be provided with the identification documents designed by the respective executive body of the Republic of Azerbaijan.
7. Employees of the internal affairs bodies shall be entitled, upon having special training and in cases provided by the legislation, to use physical force, special means and firearms. The respective executive body of the Republic of Azerbaijan set the rules for vesting, storing and carrying of special means and firearms.
8. An respective record shall be made in the personal file of each employee regarding service in the internal affairs bodies (Personnel service of the internal affairs bodies shall prepare, maintain and store such file).
Shall the location of service of the employee of the internal affairs bodies change, his/her personal file is to be transferred to the new location. The respective executive body of the Republic of Azerbaijan shall set the rules for maintaining and storing of personal files.
9. The following special ranks shall be conferred on the persons holding private and superior posts:
1) special ranks designated to the persons holding private posts:
- police private, internal service private, medical service private;
2) special ranks designated low-level superiors:
- junior sergeant of police, junior sergeant of internal service, junior sergeant of medical service;
- police sergeant, internal service sergeant, medical service sergeant;
- senior sergeant of police, senior sergeant of internal service, senior sergeant of medical service;
3) special ranks designated middle-level superiors:
- junior lieutenant of police, junior lieutenant of internal service, junior lieutenant of medical service;
- police lieutenant, internal service lieutenant, medical service lieutenant;
- senior lieutenant of police, senior lieutenant of internal service, senior lieutenant of medical service;
- police captain, internal service captain, medical service captain;
4) special ranks designated high-level superiors:
- police major, internal service major, medical service major;
- police colonel-lieutenant, internal service colonel-lieutenant, medical service colonel-lieutenant;
- police colonel, internal service colonel, medical service colonel;
5) special ranks designated supreme level superiors:
- police general-major, internal service general-major, medical service general-major;
- police general-lieutenant, internal service general-lieutenant, medical service general-lieutenant;
- police general-colonel, internal service general-colonel, medical service general-colonel.
Superiors holding supreme level posts shall have special ranks conferred on them according to paragraph 24 of Section 109 of the Constitution of the Republic of Azerbaijan.
10. Shall the person, holding the superior post, be dismissed from the Internal Affairs Bodies (except on the grounds specified in paragraphs 2-4, 7, 9 and 10 of Section 135 of this Regulation), the title “resigned” is added to his special rank.
